Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Gomvion (“Gomvion,” “we,” “us,” or “our”), governing your access to and use of our website (www.gomvion.com) and our subscription-based digital services.

By subscribing to any Gomvion monthly plan, submitting a project request, or utilizing our services, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.

Gomvion provides end-to-end digital engineering and marketing retainers, including but not limited to:

• Custom high-performance web development (built with Next.js & Tailwind CSS)
• Managed cloud hosting, daily backups, and SSL encryption setup
• Continuous search engine optimization (technical audits, on-page SEO, schema markup)
• Conversational messaging automation (WhatsApp Business API & Telegram bots)
• Headless e-commerce storefront development and payment gateway integration
• Organic social media content creation, captioning, and post scheduling

Specific deliverables, turnaround times, and monthly update allowances correspond to the subscription tier selected at checkout or via invoice agreement.

Subscriptions are billed in advance on a recurring monthly or quarterly basis using the payment method on file. In the event of a failed payment, our billing system will attempt re-collection. Accounts past due for more than 14 days may experience temporary service suspension until settled.

You retain 100% ownership of your business brand, domain name, website source code, and assets.

Unlike traditional agencies that hold your domain hostage or lock code into proprietary closed ecosystems, all custom design files, React/Next.js source code, copywriting, and content created specifically for your website belong completely to you, provided your account is in good standing with all subscription dues paid.

If you ever choose to cancel your plan, we will assist you in smoothly transferring your clean source code and DNS records to your own hosting account at no additional charge.

Our monthly subscriptions include dedicated hours for regular updates, banner refreshes, product additions, and technical maintenance:

• Standard Turnaround: Routine content and design updates are fulfilled within 24 to 48 business hours.
• Priority Turnaround: Advanced business plans receive same-day priority fulfillment for critical fixes.
• Fair Use Policy: Update requests are worked on in a queued priority sequence. Major architectural overhauls exceeding your tier allowance may be quoted as a scope addition or plan upgrade.

To ensure swift and high-quality delivery, Clients agree to:

• Provide timely feedback, necessary brand assets, and content approvals within reasonable timeframes.
• Ensure that all text, imagery, trademarks, and third-party media supplied to Gomvion do not violate copyright, intellectual property, or applicable privacy laws.
• Maintain secure management of any external account credentials (e.g. domain registrars, Stripe dashboard) provided to Gomvion for integration.

We strive for engineering excellence, 99.9% website uptime, and exceptional search engine optimization. However:

• Search Engine Algorithms: While we utilize proven, white-hat SEO best practices and structured schema to maximize organic rankings, search engine algorithms (e.g., Google, Bing) are third-party entities. No legitimate agency can guarantee exact #1 ranking positions or specific lead volumes.
• Third-Party Downtime: Gomvion is not liable for transient outages caused by upstream cloud infrastructure providers (Vercel, AWS, Cloudflare) or external API services (WhatsApp, Meta, Stripe).

To the maximum extent permitted by applicable law, in no event shall Gomvion, its directors, employees, or contractors be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or business interruption) arising out of or in connection with the use of our services.

Gomvion's total aggregate liability for any claims arising under these Terms shall not exceed the total amount paid by the Client to Gomvion during the two (2) months immediately preceding the event giving rise to liability.
